This memorandum describes the results of the 1999 Negotiated Rulemaking
conducted by the U.S. Department of Education to develop proposals
for the regulations to accompany the statutory changes related to
accreditation in the 1998 reauthorization of the Higher Education
Act.

March 12, 1999
This memorandum will further advise accrediting organizations and
other CHEA participants of the status of the implementation of the
1998 amendments to the Higher Education Act (HEA 98) signed by the
President on October 7, 1998. In the succeeding five months, the
U.S. Department of Education (ED) has begun implementation of the
new provisions of the law largely through the preparation of new
regulations. In addition, ED has taken a separate path to implement,
without regulations, the new federal Distance Education Demonstration
Program (DEDP).

A comprehensive compilation by CHEA of its HEA 98 memoranda and
specially prepared reference materials detailing all the accreditation
provisions of the new Higher Education Act Amendments (HEA 98).
These materials were prepared and distributed for the CHEA HEA 98
Roundtable held in Washington, DC, on December 15, 1998. They include
two memoranda and extensive tabular material to assist the accreditation
community. Extensive cross references and electronic links assist
the reader in accessing this material. For a brief explanation of

7 memorandum, immediately below.

1998
Most important to CHEA, the basic thrust of HEA 98 on accreditation
policies is quite positive, a sharp contrast to the unfavorable
HEA legislation passed in 1992. This is the first of several analysis
documents of the final version of the HEA. Watch this site for additional
